THE SORCERER'S APPRENTICE® TERMS AND CONDITIONS OF BUSINESS:

CONTRACTUAL OBLIGATIONS: A contract is formed between us when we notify you by e-mail that your on-line order has been accepted. In the case of orders successfully paid for by credit/debit card this will be within minutes of placing your order.

COUNTERMANDING: If you finalise an order on-line and then realise a mistake has been made or require to add supplemental information then telephone 0739-7295212 straightaway (an answering machine is available out of office hours). Alternatively email us giving your full name and address, what you ordered and what amendments or alterations you would like to make, using the following email address:

PRICING: The price of the ordered goods shall be as set out in the on-line orderforms and includes postage, packing and value added tax (if applicable). All payments must be in pounds Sterling (which Paypal will compute for overseas clients automatically when you pay on-line). Special offers, discounts and free offers are maintained whilst goods last but are subject to immediate revocation without notice.

DELIVERY: Goods will be delivered to the address entered by you on the on-line order form. We do not normally advertise goods unless we have stock of them for immediate despatch. Rarely, small extra delays may occur with cyclic restocks. Most orders will normally be dispatched by return or within several days. If we are not able to despatch any ordered goods within the quoted guidelines, we shall promptly notify you with the likely delivery date and if this is not acceptable to you, you may instruct us to refund in full your payment in respect of such goods or transfer it to other items you may wish to purchase. If you have placed a multiple item order the other goods ordered by you will be despatched immediately. We shall not be liable for any delay in despatch otherwise. Items may be sent en-bloc or in separate packages. We are very efficient at packing and addressing so Loss in Transit is a very rare occurrence but we will indemnify you from any loss in the post outbound to you. Our standard delivery is included in the prices on this website and normally takes a couple of days. You may arrange with us to pay extra for Next Day or Courier Delivery at extra cost - telephone 0739-7295212 for details. Please note that additional carriage costs requested by you are not a refundable item.

DESCRIPTIONS OF GOODS: Goods are honestly and diligently described with all Material Information provided so the customer can make a fair choice. All items are offered for curiosity value only. Mystical or magical claims cannot be guaranteed. All possible care is taken to search-out discover and provide ancient magical substances and equipment in traditional form. The yard-stick for authenticity is limited to our knowledge, specialist research and expertise. The highlighting of historical usage or case histories in advertising matter is for research and comparison purposes only.

SUBSTITUTIONS: We do not substitute. Unlike many companies we actually carry stock of the items we advertise therefore never need to substitute others for them. We reserve the right to improve specifications of goods in your favour without notice (e.g. perhaps send you 22cm long tapered candles instead of the advertised 20cm shorter ones). All sizes and measurements are approximate.

BESPOKED ITEMS: If we undertake to make a special, 'one-off' or made-to-measure item/s for you; or personalise or modify any stock-item/s at your request the order for such an item cannot be cancelled but is of course subject to being correct and fit-for-purpose.

CUSTOMERS UNDER 18 YEARS OF AGE: We have a strict rule not to sell to under 18s but parents/guardians can give written permission for under 18s to purchase from us. Permission may be selective (i.e. only books) or global as wished. Bear in mind that a few items on this website (clearly marked) are not available to under 16s under any circumstances. FIT FOR PURPOSE: We warrant that, at the time of delivery, the ordered goods will, subject as hereinafter provided, correspond with the description on this website, will be free from defects in materials and workmanship and will be of satisfactory quality (within the meaning of the Sale and Supply of Goods Act 1994). Risk of damage to, or loss of, ordered goods shall pass to you at the time of delivery.

CLAIMS: Any claim by you that any ordered goods fail to correspond with the description on this website or that they are defective or not of satisfactory quality, must be notified to us by e-mail to this address:

If you make a valid claim we shall replace the goods in question free of charge or, at your option, refund in full your payment in respect of such goods. We ask you to take all reasonable care of the goods and return them to us as recieved within a reasonable time. If during the first six (6) months of use an item develops a fault we will replace or reimburse you for it. If during the next 6 months an item wears out under reasonable use we will repair or fix at no cost to you other than your carriage charges in sending the item back to us. Any period of time specified in these conditions will run from the first date upon which the goods are delivered to you or your agent. If for any reason you receive replacement goods any rights available to you in respect of those replacement goods shall only be available for the remainder of any such period.

BUSINESS TO BUSINESS / BUSINESS TO OVERSEAS CUSTOMERS OUTSIDE THE EUROZONE : Except where you contract with us as a 'European Consumer' (see Cooling Off Period below), our returns policy is as follows. If you are not entirely satisfied with any ordered goods, we will refund your payment for such goods after deducting a 15% administration charge subject to (a) you dispatching such goods back to us, at your cost and with proof of posting, within 7 days of delivery to you and (b) our receiving the goods back unused and in undamaged condition. Risk of damage to, or loss of, such goods shall pass to us at the time of delivery to us.

COOLING OFF PERIOD: Under the EEC Distance Selling Regulations you, as a 'European Consumer', have a cooling off period of 7 working days from the date following the date upon which you receive goods from us. During that period you may cancel the contract. Where your contract with us is as a 'European consumer' (ordinarily permanently resident within an EEC member country) the provisions of this Clause shall apply and prevail over any other terms set out in these terms and the restrictions and limitations contained in Business-To-Business / Business-to-Overseas Customers Outside The Eurozone Clause (above) shall not apply. CANCELLATION RETURNS FOR EUROPEAN CONSUMERS: In the event that you cancel the contract it is your statutory duty to take all reasonable care of the goods. You shall be responsible for returning the ordered goods to us and we shall reimburse any monies paid to us by you as soon as we can or at the latest within 30 days of the notice of cancellation being given by you. If you fail to return the goods or refuse to return the goods we have a statutory right to charge you our costs in legally reclaiming the goods from you. You should retain evidence of having sent a cancellation otice to us (such as a certificate of posting or hard-copy print out of the email) as well as evidence of posting off the returned item. Reimbursements can only be made to the person who paid for the goods.

FREE OFFERS/GIFTS: Gifts which are claimed by clients as part of a free offer must be returned in reasonable condition at the customer's own expense if the customer exercises his/her right to cancel the order.

We reserve the right to improve specifications of goods without notice. Prices are correct at time of publication. All sizes are approximate. We cannot be held responsible for any inconvenience arising from failure to provide the advertised delivery service because of adverse weather conditions or unpredictable delays caused by strikes, breakdowns, security operations, traffic delays, acts of terrorism etc which are unexpected and could not have been reasonably prevented. Any error or omission in any information or document issued by us shall be subject to correction but will not affect any existing contract of sale previously entered into . The person who pays for the goods will be considered the purchaser in law whether or not the goods are being bought for someone else and the contract of sale with that person will not be reassignable.

We expect the typical customer to be reasonably fit and healthy. If you are significantly unwell, subject to allergies, are taking a course of treatment, are pregnant, a registered drug addict, have a history of chronic ailments or are undergoing psychiatric help then it is your responsibility to clear your intentions with your doctor or/and explain them to us before you embark upon a purchase. .

LIMITATIONS: Except in the case of death or personal injury caused by our negligence, our liability to you by reason of any representation or any implied warranty, condition or other term, or any duty at common law or under these terms, for any special, indirect or consequential damage is hereby limited and excluded to the fullest extent permitted by law.

ADDITIONAL TERMS FOR ORDERS SENT IN BY MAIL AND PAID FOR BY CHEQUE, CASH OR POSTAL ORDERS.

PAYING BY CASH: It is best to use Registered ('special delivery')or Recorded Post. Obscure notes using dark / opaque paper or card. DO NOT SEND COINS as these may burst out when being machine-handled at the post office. We accept MULTIPLES OF 1st OR 2nd CLASS DENOMINATION STAMPS up to a maximum of £3.00 to take care of the odd few bob. Overpayments will be credited. Always put your return address on the back of your envelope. If sending cash you do not have to pay the Bank Transaction Fee. Regular clients often send cash through the post and save considerably on poundage but if you adopt this method you do so at your own risk. Goods paid for by cash are usually despatched by return or within several days.

POSTAL ORDERS: If you Cross your postal orders they must be paid in through a bank and incur the Bank Transaction Fee. So only if you wish to cross your postal orders please add £1.00 Bank Transaction fee to cover this as shown on the orderforms. If you do not cross them we can pay in at the Post Office so you do not have to include this bank charge. However for security purposes please make uncrossed POs out clearly to: "THE SORCERER'S APPRENTICE, LEEDS". Orders paid for by Postal Orders are despatched by return post or within several days.

PERSONAL CHEQUES: Please read the following VERY carefully. The banks are now working towards wholly electronic means for processing transactions (debit cards). To switch emphasis from cheques to debit cards they are attenuating their support for cheques by bringing in swingeing penalty / handling / paying in charges. We do not intend to pass these costs onto non-cheque users. If you choose to pay by cheque you must add the £1.00 Bank Transaction Fee (see box on orderforms). This is not an express clearance fee (the banks now charge £30.00 for that!). Please note the following:

• INSUFFICIENT FUNDS: If your cheque fails through lack of funds or by cancellation we will charge you a compulsory £15.00 administration fee to cover the extortionate charge-back costs levied by the banks.
• Do not risk using a cheque if your account is likely to go into the Red because the banks will make you pay dearly for it in charges to us which you will have to cover.
• POST DATED CHEQUES: We do not accept Post Dated Cheques - If you send one we will charge you our costs for returning it.
• ALTERATIONS TO CHEQUES: Cheques with alterations of any kind, will be returned to you for replacement. PLEASE DO NOT SUBMIT ALTERED CHEQUES (whether the alteration is signed or not). As cheques do not cost you anything please make out a new one. Remember PRISTINE cheques only are acceptable to the banks. No errors or amends allowed.
• CHEQUE CLEARANCE: Orders paid for by Personal Cheques may be subject to a delay for clearance, depending upon the clients' buying record. A string of orders paid for by cheque which have been delivered by-return does not guarantee that all subsequent orders placed by cheque will be despatched by return also. Therefore you should assume there WILL be full clearance delay on each and every cheque you present. If your cheque is held for clearance then we cannot enter into correspondence about the order until 21 days have elapsed. There is no purpose in you writing to us in-between time to say that your statement shows that the cheque has been cashed because the banks will not confirm encashment to us unless we pay them 25.00! Enquiries concerning delays on orders paid for by cheque which are within 21 days of first placing the order will be ignored unless you enclose 25.00 extra to paythe bank to find out.. These conditions have been imposed upon us. If you do not like them please choose another form of payment. (that's what the banks want!) Orders by cheque are fine if there's no hurry but Do not risk using a cheque if your order is in any way urgent or time-scheduled.
• CHEQUE 'GUARANTEE' CARDS: The Banks have ruled that Personal Cheque Guarantee cards are invalid for mail-order purchases. PAYEE: Please make cheques payable to: 'THE SORCERER'S APPRENTICE'

BANKERS OR BUILDING SOCIETY CHEQUES: Can be obtained over the counter and should also include the £1.00 bank Transaction Fee. The benefit is that as payment is guaranteed there is no clearance delay and your order is despatched by return.

CREDIT CARDS / DEBIT CARDS:

Credit or Debit Card Orders paid on-line are handled by Paypal our card processors. When Paypal handle your card on our behalf we do not see your card details.

When you post in an order or telephone us with your credit card we handle your card in-house. We accept all Mastercard / Visa Credit Cards and also Barclays Connect , Maestro, JCB, Switch , Electron debitcards . If you choose to pay by credit card there will be a 4.5% card handling charge (maximum £2.00) Authorisation will be obtained for each sale. We reserve the right to make a processing charge to cover aborted credit / debit card orders which fail due to lack of funds. On your FIRST order goods MUST be sent to the address where the credit / debit card account is registered (where the card company sends statements)- make sure you state this address in the 'Home address panel' on our orderforms. After the first sale you can have goods sent to any third-party / care-of address you choose by quoting your registered address and your SAOS/customer number. Please note that for extra confidentiality the charge will appear on your statement as S.A. SALES.

Credit / debit card orders which are phoned or posted in are usually processed and despatched by return or within several days.

CREDIT CARD FAILURES CAUSED BY INSUFFICIENT FUNDS:

Credit/debit card orders placed on-line are authorised automatically when you check out and will only succeed if your card is in credit. Please do not place a credit or debit card order with us by phone or by post unless you are certain that you have enough balance / credit to amply cover the sale . We electronically authorise every sale and the credit / debit card company's computers will refuse the sale if there is not enough in your account or you are over your limit. Even if your account is only one cent / one penny short the credit card computer will reject the sale. Hand-processing of a phoned-in or mailed-in order (picking, sorting, preparation and packing) is extremely time consuming and we cannot process your card accurately until that work is first invested in the sale.   Therefore, if you place an order which is refused by your credit / debit card company because of shortage of funds we will expect you to honour the sale in some other way (Cash / Banker's Cheque / British Postal Orders etc.,) or by the use of a different card. If the first card you give us is rejected because of insufficient funds we will apply a £2.00 charge for re-presenting that card. If you ask us to use a different card and the sale is refused because of insufficient funds we will charge you £2.00 for that and each subsequent failure of credit/debit cards used. If you ask us to reclaim the sale by deducting item/s to equate with your available credit that means we will have to completely rework and repack the sale; this will be considered a separate order .  As such a reprocessing fee of  £2.00 will be applied on top of  the £2.00 re-presentation fee..  If you decide not to go ahead with the order an order-cancellation fee of £5.00 will be charged to cover our time and labour. The placing of an order by credit / debit card will be deemed an acceptance of these conditions.

ECOLOGY / ENERGY LEVY: When you purchase a new tyre for your car a proportion of the purchase price includes a levy by the manufacturers to pay for recycling the product at the end of its life. You are being made to pay for the hidden cost of complying with government requirements concerning supposed threats from global warming etc. Most businesses put up prices to cover these extra costs but that makes it impossible for you to see what you are paying for.  The government has recently imposed futher stealth taxes in the form of Energy and Waste Levies. Just as the travel industry now itemises Journey Taxes so that travellers can see how much more they are having to pay to government when they take a holiday; and just as the insurance industry now itemises the governments ever-ascending 'insurance tax' we have decided to show the cost of impositions like this separately too on the basis that this is a fairer method. If every member of the public is made aware of it the government may not be so quick to play the stealth tax card unnecessarily in future.   The 50p per order Eco Levy on our posted in order forms covers increased costs on energy, recycling and disposal of waste and the ginormous bureaucratic costs forced upon businesses by a plague of government pen-pushers who have hijacked the conservation bandwagon for ulterior motives. URGENT ORDERS / SPEED OF DELIVERY: With 'Secure Remittance' (i.e. Cash, POs,Banker's Cheques, Credit / Debit Cards) our standard delivery is 3-5 days from receipt of your order. Post and packing charges for standard delivery are included in all prices- We work on the basis that everyone wants their orders 'urgently' and so process immediate post on the first working day the order is received. Customers usually get their goods within a week. If this is not fast enough you can request NEXT DAY COURIER delivery. This costs £8.50 extra (see box on orderforms and Conditions in panel above credit card box overleaf). Next Day Delivery only applies to mainland UK and assumes that all the items ordered are stock (which they usually are). NOTE; *Hand-blended magical oils are, made up fresh for you on the appropriate magical day and hour, thus may entail several days wait to catch the specific magical tide. Allow for several extra days delay if your order contains special concoctions. Please give a daytime telephone number for clarification. and a DEADLINE if there is one.

• (5) PAYMENT BY CREDIT / DEBIT CARD FOR OVERSEAS ORDERS: We are glad to accept Credit / Debit Card Orders from overseas clients but due to new regulations by card issuers the first order you place with us using a non-UK credit / debit card MUST be to the address where the card is registered and it MUST be YOUR card or authorisation may fail.
• (6) GIRO CHEQUES We accept GIRO cheques from Europe providing they are in STERLING. . We also accept U.S. dollars at the current bank rate ( see http://www.sorcerers-apprentice.co.uk/currenco.htm for today's rates). If you do send U.S. Dollars add 5% extra to cover bank currency exchange charges. We will credit you with any over-remittance once the order is processed.
• (7) EURO CASH: If Ordering From Within The EURO ZONE:: Yes, We Accept EURO MONEY! Total your order in British pounds (Sterling).
